Terms and Conditions
BOOKING: When booking your wedding videography, a $250 deposit is required. Upon receipt of the deposit that day will then be exclusively reserved for you, effectively taking that day “off the market”. All reservation fees are non-refundable.
PAYMENT: An invoice will be issued 4 weeks before the wedding for the remaining balance on the wedding photography package. The balance is to be paid in full no later than 14 days before the wedding.
LIABILITY: Belle Holliday-Williams trading as BHMP takes the utmost care with respect to exposure, transportation and handling of the footage. However, in the unlikely event that all of the video should be lost, stolen, damaged or destroyed for reasons within or beyond BHMP’s control, BHMP`s liability is limited to the return of all payment received for the event package.
The limit of liability for a partial loss of original tape/tapes shall be a prorated amount of the package selected, based on the percentage of originals lost.
COPYRIGHT AND LICENCE: All files, video footage, deliverables are the legal copyright of Belle Holliday-Williams trading as BHMP at all times, as described by Australian Statutory Law. Photographs or videos (or any material) supplied to clients whether in print form, display on the internet or inclusion on a DVD are intended for personal use only. If any of such material is required for commercial purposes, a request must be made in writing. Permission is granted on a case by case basis, and in no circumstance shall material / discs be sold to any agent or third party.
FINAL VIDEO: Belle Holliday-Williams trading as BHMP will make every effort to give the Client the best audio and video recording possible, but makes no guarantee either expressed or implied, in regard to the quality of audio/video recordings that are subjective and influenced by many factors beyond the complete control of Belle Holliday-Williams trading as BHMP especially during live or unstaged events, like weddings. It is also understood that the client is hiring Belle Holliday-Williams trading as BHMP for their technical and artistic expertise and, therefore, BHMP reserves the right to edit the footage as they see fit. Belle Holliday-Williams trading as BHMP does not guarantee that everyone involved in the event will be videotaped or will be included in the final edited videotape.
RE-EDITING OF VIDEO: Requests for changes to the final edited videotape will be subject to an editing surcharge of $50 per hour unless an obvious mistake was made by Belle Holliday-Williams trading as BHMP. In which case, Belle Holliday-Williams trading as BHMP will re-edit the videotape at no additional charge to the Client.
MUSIC CHOICE: Any particular music chosen by the client for the edited video has to be supplied before the filming of the event. If no music choice is given, we will choose the music and a charge will be made for subsequence changes. There is an APRA license fee for the use of commercial music included in DVD/videos. This fee is paid by Belle Holliday-Williams trading as BHMP to APRA as part of your videography package.
VIDEO EDITING, PRODUCTION AND DISTRIBUTION: Any, all or none of the videos created in this engagement may be used and published by Belle Holliday-Williams trading as BHMP in future marketing endeavours. This may include (however is not limited to) publishing the video on website(s) or any other 3rd party media. By completing a booking you agree to grant Belle Holliday-Williams trading as BHMP royalty-free rights to publish and distribute any of the video content captured as part of this engagement.
MODEL RELEASE: It is the responsibility of the client to advise any and/or all participants and attendees that the event will be videotaped. All parties attending the event will therefore be considered as consenting to be included in the final edited video and/or commercial/promotional video by their presence.
VIDEOGRAPHER: When booking BHMP to cover your event, your videographer will be Belle Holliday-Williams as well as another trained assistant. In the unlikely event of serious personal injury or emergency circumstances beyond the control of Belle Holliday-Williams trading as BHMP, a substitute videographer, subject to the acceptance by the client, may be dispatched to fulfill the obligations of videography herein contracted. If securing a videographer is not possible, or if the client declines such substitution, the client will receive a full refund of the deposit. Total liability of Belle Holliday-Williams trading as BHMP is limited to the refund of the deposit and any monies paid toward the final cost of the video.
COVERAGE TIME: A charge of $150.00 per hour will be charged if Belle Holliday-Williams trading as BHMP is required to continue coverage after 11:59pm on the day of the wedding.
VENUE RESTRICTIONS: It is the responsibility of the client to secure permission of the church, synagogue or other official to videotape the ceremony/event. The undersigned, having read the above contract, agrees to the terms as set forth.
MEALS: In the event reception coverage is booked (Grand Extravaganza and A Day to Remember packages), a meal and refreshments at the reception is to be provided for both (two) videographers. No special seating is required. This allows the videographers to have a short break whilst still remaining in the reception venue and not having to leave to purchase dinner, which makes sure no important video moments are missed.
TRAVEL: In order to keep our prices down, our wedding packages are priced to include travel within 100 klms distance from Newcastle. However, with some additional travel / accommodation expenses. We can also travel to areas located more than 100 klms from Newcastle within Australia, when the ‘Grand Extravaganza’ package is booked.
Travel fee is $0.45 per kilometre outside 100 klms from Newcastle plus 2 nights standard accommodation.
DELIVERY: Video will be completed and ready for delivery within eight weeks of the shoot date. Because each video project is different in nature, Belle Holliday-Williams trading as BHMP cannot guarantee the specific length of video.
